Lawsuit Filed over the Death of a Baby Due to Medical Malpractice

Clevelanders who have children may be saddened when reading this news about a child who died during delivery in Nov. 2011. According to the reports from Nov. 18, 2013, the mother claims that medical negligence was the reason for her child’s death.

The lawsuit was filed during the week of Nov. 15, according to the woman’s attorney, and it claims that the woman entered Lexington Medical Center when she was 40 weeks and 2 days pregnant with her baby, Braylyn. The woman had been brought into the hospital to have her labor induced, according to the lawsuit. She allegedly had a complicated medical history that had issues like gestational diabetes, as well as a problem with a previous delivery that the hospital should have been aware of.

The lawsuit states that the woman was started on Pitocin/Oxycotin at around 4:55 a.m. on Nov. 15, 2011. The lawsuit also claims that during that day, there were multiple times when the baby seemed to be in distress, although the medical staff allegedly did nothing about it. When the child was born at 6:34 p.m., the baby was not breathing. The lawsuit states that the child did not have a heartbeat and was completely unresponsive. The medical staff pronounced the child dead at 7:29 p.m., according to the lawsuit.

Sadly, the autopsy of this child reported that the cause of death was hypoxic conditions. That means that the child was asphyxiated, according to the report. The lawsuit claims that the woman and her baby were not monitored enough, and that is what resulted in the baby’s death. The woman is allegedly seeking damages in excess of $10,000.
